Warranty Terms

Our products are backed by guarantees that are protected under the Australian Consumer Law. This ensures you have the right to a replacement or refund for significant faults, as well as compensation for any foreseeable loss or damage. Moreover, if the product doesn't meet acceptable quality standards, you're entitled to have it repaired or replaced.

 

In addition to these legal rights, ZAPPAZ provides a 12-month warranty for products used in private households from the purchase date, with a 3-month warranty period for commercial use. See specific product warranty periods on the product's listing. It's important to note that our warranty does not limit your rights under Australian Consumer Law.

 

Please be aware that our warranty excludes damage from regular wear and tear, accidents, misuse, lack of maintenance, neglect, or external causes. Additionally, it becomes void if the item has been modified or tampered with by unauthorized individuals.

 

Consumable components and accessories, such as chains, carry bags, batteries, wheels, blades, and safety gear, are not covered by our standard warranty once they've been used. If you receive a faulty part or consumable component, please contact us before using it.

 

The resolution process for any faults may involve returning the item for assessment. Depending on the issue, you may be eligible for a full refund or replacement. Please note that some situations may result in a reduced refund. In minor cases, we may cover the cost of replacement parts or provide them to you. Other alternatives may be offered to the satisfaction of both parties.

 

To claim warranty on your item, please follow the outlined process in the Return section.

 

Please note that warranties do not apply to items resold or rented for profit.

Our guarantee is specifically for the original purchaser of the product and cannot be transferred.

Voiding Of Warranty

Our warranty will become void if the bicycle is used for activities other than normal riding, including but not limited to failure to follow the owner’s manual, using the bike for commercial purposes, or engaging in competitive events such as bicycle racing, stunt riding, or jumping.

Punctures

Please note that punctures are not covered under warranty.

Reimbursement

If the product is found not to be defective due to faulty materials or workmanship, the Warrantor may seek reimbursement from you for any costs and expenses incurred.

Limitation Of Libility

The company shall not be liable for consequential, special, or indirect damages.

Conditions Of Use

A bicycle is typically subjected to various impacts, shocks, and environmental conditions. Damage caused by such factors, including accidents and exposure to water, salt, or extreme temperatures, is not considered a manufacturing fault and is not covered under warranty.

Water Resistance

While your electric bike and its components are water-resistant against normal damp conditions, they are not waterproof. Riding in heavy rain or submerging the bike in water may cause damage not covered under warranty.

Assembly / Adjustments

During assembly, certain parts may require adjustment due to transportation. Instructions for adjustments will be provided if necessary. Failure to properly assemble or adjust the bike may void the warranty. Any fees incurred for assembly by a third-party technician are not covered under warranty.

Cosmetic Damage

Minor scratches due to transportation are possible. We will provide touch-up paint for any visible scratches. However, requests for part or bike replacement solely due to cosmetic damage cannot be accepted.

Warranty Claims

Ensuring your satisfaction with your purchase is of paramount importance to us. While we strive to deliver impeccable products and services, occasional issues may arise despite our best efforts. Recognizing this possibility, we outline the procedures and expectations regarding warranty claims below.

Warranty Scope

Our warranty covers major electrical or mechanical faults with a fault rate averaging approximately 1%. In the rare event that a fault occurs, we commit to promptly addressing the issue. However, it is imperative for customers to maintain a positive and cooperative demeanor during the resolution process to facilitate effective fault diagnosis and resolution.

Initiating a Claim

Warranty claims must be lodged directly with the seller via email, accompanied by proof of purchase. All email enquiries to: info@zappaz.com.au.

 

Upon request, the buyer is expected to furnish photographic or video evidence of the fault and to cooperate in performing troubleshooting steps as directed by the seller, which may involve technical procedures.

Assessment and Resolution

All warranty claims are subject to assessment by our technical team, whose determination regarding coverage is final. In cases where the cause of a fault cannot be conclusively established, we will assume responsibility for replacement or repair in favor of the customer.

 

Should standard troubleshooting methods fail to identify the fault's root cause, we may request the return of specific bike components or, in exceptional circumstances, the entire bike. Alternatively, replacement parts may be dispatched for testing, with the defective part to be returned upon receipt of the replacement.

Packaging and Technical Expertise

Customers are advised to retain the bike and accessory packaging for potential return to our service center, should the need arise.

Furthermore, customers are expected to possess a basic level of technical proficiency or have access to the necessary tools to facilitate remote system recovery with our guidance.

These guidelines aim to streamline the warranty claims process and ensure a satisfactory resolution for all parties involved.

Delivery Terms

Our commitment to swift delivery means your order is typically dispatched within 1 business day. Please ensure your address is accurate during checkout, as our system cannot process order cancellations once payment is made. Expect your item to arrive within 5-10 business days via courier or Australia Post, depending on its size and weight. Check the individual product page for specific delivery methods.

 

Please note: PO Boxes cannot receive items exceeding 25kg or longer than one metre. It is the buyer's responsibility to provide the correct delivery address and mobile phone number before payment. Changes made after checkout will not be accepted.

Shipping delays can also happen due to issues with the freight company or customs. Please work with us and allow time for processing.

Aus Post Deliveries

For deliveries via Australia Post, recipients may receive a notification card for pickup at their local post office. A signature is required upon collection. Buyers will incur a re-delivery fee for items returned due to incorrect addresses or failure to collect.

Courier Deliveries

Once your item arrives at the nearest depot, the Courier provider will email updates and arrange delivery during normal business hours (9am-5pm) on weekdays. Weekend, holiday, and after-hours delivery is unavailable. Couriers may require assistance unloading, and delivery is limited to property entrances only.

Buyers will be charged a re-delivery fee for undeliverable items or returns due to incorrect addresses or failed deliveries. Door-to-door delivery cannot be guaranteed for all customers, particularly those in remote areas who may need to collect from their nearest freight depot.

30 Day Refund Period

At Zappaz, we stand behind our products with confidence, offering an extensive 30 Day Refund Period, as mandated by Australian Consumer Law. 

Please note, changes of mind are not covered under this guarantee for returns or refunds.

 

When Our 30 Day Refund Period Applies:

  • Product remains in original "un-used" condition and packaging.
  • Product substantially differs from what was ordered.
  • Original purchaser with original receipt.
  • Major manufacturers' faults, defects, or failures.

When Our 30 Day Refund Period Doesn't Apply:

  • Damage in products not due to manufacturer faults. For example: Scratches, rider breaking parts, etc.
  • Products not in original "new" condition or packaging.
  • External factors like acts of God or natural disasters.
  • Changes of mind or dissatisfaction with the item.
  • Misuse resulting in faults, failures, or damages.
  • Orders placed over 30 days from the order date.
  • Matters unrelated to the product's quality and performance.

Requests for tasks, services, or repairs against our advice may lead to declined refund or warranty requests.

Partial Refunds

Partial refunds may be issued in circumstances like items not in original condition, damage not due to our error, return requests made after 30 days, or external causes unrelated to the product.

Minor Faults

Minor faults, like squeaking sounds, gear adjustments, brake tightening, etc, will not qualify for a refund.

Major Faults

Major faults, resulting in serious damage to multiple components beyond reasonable repair, are eligible for refunds if no warranty repair is available.

Returning Items To Us

We're committed to making the return process as smooth as possible for you. We can assist by arranging couriers to collect securely boxed products from your location for return shipping. However, please note that the customer will be responsible for covering the shipping costs.

 

It's important to ensure the product is properly repacked in its original packaging to avoid any damage during transit. If the original packaging is not accessible, a fee of $200 will be charged for resending packaging material.

 

Additionally, please pack the product securely to prevent any damage during return transit. If the product is damaged due to improper packing, the cost of repair will be the customer’s responsibility.

 

To complete your return, a receipt or proof of purchase with your name is required. 

Exchanges

Exchanges are offered only for defective or irreparably damaged items, not for changes of mind.

However, ZAPPAZ PTY LTD explicitly disclaims liability for any misrepresentation or alteration of processes occurring at these facilities and shall not be held responsible for any misconduct therein. Nevertheless, it is emphasized that all chosen facilities maintain reputable and quality-assured standards. Customers are obligated to fully comprehend the proper maintenance and safe use of the products and components provided. While our website and manuals offer guidance, unforeseen hazardous scenarios may exist beyond those outlined.

Warranty Remedy

Under the warranty provided by ZAPPAZ PTY LTD, the sole remedy, or any implied warranty, is restricted to the replacement or repair of defective parts, determined solely by ZAPPAZ PTY LTD, with parts of equal or greater value. Except as specifically prohibited by law, ZAPPAZ PTY LTD shall not be liable for any property damage, personal injury, death, fire-related incidents, loss of use, loss of opportunity, loss of contract, loss of goodwill, interruption of business, loss of profits, consequential, direct, indirect, incidental, special, or punitive damages arising from contract, warranty, negligence, product liability, or any other theory. ZAPPAZ PTY LTD disclaims liability for accidents, misuse, abuse, loss, or injury to the rider or third parties, regardless of the cause, including ebike power, speed, parameter setting, component defects, or malfunctions.

Customer Responsibilities

Customers bear all responsibilities and liabilities for products, including but not limited to electric bikes, electric scooters, conversion kits, batteries, electric bike components, brakes, bike mechanical parts and adjustments, electrical wiring, unforeseen occurrences, safety issues, maintenance, and services.

Traffic Regulations and Restrictions

Electric bike riders are required to adhere to all traffic regulations, geographical or age restrictions, and stay informed about rules and updates pertaining to their vehicle type.

Li-Ion Battery Safety

Customers are fully responsible for understanding safety concerns and regulations related to the storage, charging, usage, and transportation of Li-Ion battery packs.

Street Legality

When an electric bike or conversion kit is designated as "Street Legal," it signifies that the electric bike or trike complies with Australian Electric Bike Regulations, as per the knowledge of ZAPPAZ PTY LTD. These products are categorized as bicycles, exempt from the requirements of insurance, license plates, or driver's licenses. However, it is imperative for users to verify the current laws at the provincial/state, county, and local levels to ensure lawful and safe riding practices.

Off-road Usage

It is essential to understand that being "Street Legal" does not grant unrestricted access to all bicycle pathways; certain parks and trails may impose restrictions on the use of electric assist bikes.

Modifications and Liability

Any alterations made to the settings or components of electric bikes or conversion kits, such as controller or motor upgrades, may result in the loss of street legality, irrespective of who performs the modifications. In the event of default settings or component modifications, ZAPPAZ PTY LTD disclaims any responsibility for fines, damages, losses, or other consequences arising from the operation of such modified bikes.

 

ZAPPAZ PTY LTD bears no responsibility for fines, damages, losses, or other consequences arising from the operation of the bike on public roads where it is deemed non-compliant with local regulations or unsuitable for use, for any reason whatsoever.

Pre-order Terms

By placing a pre-order, you acknowledge and agree to the following terms:

 

a) Expected Availability Date: The anticipated availability date for pre-ordered items will be provided upon placement of the pre-order. This date signifies the commencement of order processing within our warehouse facilities. Please allow 5-7 business days for order processing before dispatch.

b) Delivery Timeframe: The estimated delivery time ranges from 4-10 days from the dispatch date, resulting in a total expected delivery period of approximately 9-17 days from the advertised availability date. This timeframe is subject to change and may vary based on unforeseen circumstances.

c) Disclaimer: The provided availability date is an estimate, and delays may occur due to unforeseen factors such as manufacturing issues or shipping delays. While you retain the option to cancel your pre-order and receive a full refund before order processing, ZAPPAZ PTY LTD cannot guarantee a precise availability date and assumes no responsibility for delays in processing pre-orders. Despite efforts to anticipate potential delays, unanticipated circumstances may result in dispatch occurring later than initially indicated.

Typographical and Illustrative Errors

ZAPPAZ PTY LTD shall not be held liable for any direct or indirect consequences arising from typographical or illustrative errors found within our website, communications, or shared materials.
